The property is gated. It is a requirement that once you enter you lock the pole gate behind you. Everyone in Bear Trak pretty much know everyone in Bear Trak. No one that I know of lives there year round. These are truly off grid properties serving at hunting camps or getaway retreats and maybe for family gatherings. Everyone keeps an eye out for everyone. Important to count on each other in locking gate & watching out for each other due to being so remote.
This property is very remote. It's 2 miles deep in... The road is rough, made of dirt, shale & rock. Recommend a SUV, Jeep, Truck. Coming in & out during winter would be 4X4 only. There is NO RMA (Road Maintenance Agreement). The road is what it is. When/If the road gets to bad, "someone" will bring in a load of gravel to fill as they head into their place. That doesn't happen often.
There is NO HOA (Home Owners Association) or any fees. There are NO C&R's (Covenants/Restrictions). Property is being sold with surface rights ONLY. Property access is by Prescriptive easement, NOT a ROW (Right Of Way).
A prescriptive easement is an easement acquired through open and notorious use of an owner's land which is adverse to the owner's rights, for a continuous and uninterrupted period of years. The period of years required for such an easement is defined by state laws. WV Law is 20 years.
The use of the easement must truly be adverse to the rights of the original owner of the property through which the easement is sought and must be without the landowner's permission. If the owner has given permission to use the land, the possession is not adverse.
For example, Johnny bought property that did not have access to a public road, but he used the private gravel road of his neighbor to reach a public road for ten years. A court may grant him a prescriptive easement if the owner of the other property did not ask him to stop using the private road.
There is NO, Electric, NO Water (of any kind)... (you might be able to dig a well but it will be deep since you are on top of the mountain/ridge), NO sewer/septic, NO internet service, Cell Phone service is very spotty! And... everyone owning property in Bear Trak wants to keep it that way. Most folks use: A generator for power; wood or propane for heating; haul water in or use a cistern to collect water from roof(s) with a water filtration system; use an outhouse or compost toilet (some may have installed their own version of a septic tank/system).
Lot dimensions are approx 220' X 2000'.
This property abuts the Back Creek Sportsman's Club; as of 4-14-2022: There is an approx 2 year wait list to join. New members are heavily screened. Cost is $410 for the year 2022.
The nearest gas station/convenience store & Mom/Pop Restaurant is 10 miles away. Walmart, Lowes, Movie Theater, Restaurants & Hospital are approx 25 miles away.
I provide this additional information not to scare you from the property! I'm just being a straight shooter. I'd hate for someone to drive ... say... 4 hours one way to see the property to say the road is to rough, there's no electricity? Etc. Just don't want to waste your time nor mine 🙂
